DARI KRIMINALISASI KE PROTEKSI: REKONSTRUKSI MEKANISME ANTI SLAPP TERHADAP AKTIVIS LINGKUNGAN DALAM RUU ENERGI BARU DAN TERBARUKAN

The practice of Strategic Lawsuit Against Public Participation (SLAPP) against activists participating in the formation of renewable energy policy in Indonesia is increasingly concerning, yet no study has specifically examined the weaknesses of Anti-SLAPP mechanisms in the context of the Renewable Energy Bill (RUU EBT) legislation. This study aims to reconstruct an effective Anti-SLAPP mechanism to protect activists in the legislative process of RUU EBT in Indonesia. The method employed is normative legal research using statutory, conceptual, and case approaches. The findings reveal that the existing Anti-SLAPP mechanisms contain three structural weaknesses, namely limited sectoral coverage restricted to environmental matters, the absence of cross-institutional procedural mechanisms among law enforcement agencies, and the absence of critical participation protection clauses in the Academic Draft of RUU EBT. Based on Hadjon's legal protection theory, reconstruction is built through two dimensions, namely preventive protection through strengthened mechanisms at the police, prosecutorial, and legislative levels, and repressive protection through reinforced preliminary rulings, reversal of the burden of proof, and a three-dimensional SLAPP victim recovery mechanism. This study contributes an original and contextually responsive Anti-SLAPP protection framework specific to the renewable energy sector
